ABOUT THE PRACTICE

The firm's history and purpose

Meriwether & Co was established to serve a specific kind of need: the small or medium-sized Malaysian business that encounters genuine legal questions in the course of its work, but has no practical means of obtaining qualified legal input without the cost and overhead of engaging a large firm.

The practice takes its name from the tradition of the solicitor who sits with the client across the bench — not to issue pronouncements, but to read carefully, consider the position, and explain it plainly. The firm's advice is always given in writing. A written opinion or review is something a client can refer back to, pass to a colleague, and use as the basis for a considered decision. Spoken advice, however thorough, is not.

The firm's three core services — written opinions, contractual review, and the Continuing Counsel Year — have been designed with the practical circumstances of Malaysian businesses in mind. Not every legal question justifies the cost of litigation or large-firm engagement. Many questions can be answered thoughtfully, clearly, and at a fee that makes sense for the matter.

Since its formation, the firm has worked with clients across a range of industries, including trading, professional services, technology, logistics, and property management. The common thread is businesses that want to understand their legal position before they act, rather than after.

The firm's solicitors hold current practising certificates with the Malaysian Bar and carry professional indemnity insurance as required by Bar Council requirements. The firm is committed to the standards of professional conduct set by the Bar Council of Malaysia and operates entirely within the ethical framework of the profession.

PROFESSIONAL STANDARDS

How the firm conducts its work

The firm operates within the framework set by the Bar Council of Malaysia. Below are the principal professional standards the firm maintains across all engagements.

Malaysian Bar membership

All solicitors at the firm hold current practising certificates issued by the Malaysian Bar, renewed annually in accordance with Bar Council requirements.

Professional indemnity

The firm carries professional indemnity insurance at the level required by the Bar Council's minimum terms and conditions, providing clients with coverage in the event of a professional error.

Legal professional privilege

All client communications with the firm's solicitors are protected by legal professional privilege under Malaysian law, meaning they cannot ordinarily be disclosed to third parties without the client's consent.

Written terms of engagement

Every client engagement begins with written terms setting out the scope of the work, the agreed fee, and the anticipated timeline. No work commences until those terms are accepted in writing.

Confidentiality obligations

The firm maintains strict confidentiality in respect of all client information. Information shared during an engagement is not disclosed to any person outside the firm without the client's written authority.

Bar Council conduct rules

The firm's practice is governed by the Legal Profession Act 1976 and the Rules Accompanying the Etiquette and Professional Conduct of Advocates and Solicitors. Complaints can be directed to the Bar Council's Complaints Committee.

Legal counsel for Malaysian businesses

Small and medium-sized enterprises in Malaysia frequently encounter legal questions that sit outside ordinary business knowledge — questions about the enforceability of a clause, the meaning of a statutory provision, or the scope of a contractual obligation. Obtaining qualified legal input on those questions, at a cost proportionate to the matter, has traditionally been difficult for businesses without established relationships with large practices.

Meriwether & Co was formed to address that gap. The firm's practice is oriented entirely toward the legal questions that arise in the day-to-day operations of businesses: contracts, commercial arrangements, regulatory obligations, and disputes of a nature that warrants legal consideration before action is taken.

The firm's solicitors are experienced in Malaysian commercial law, the Contracts Act 1950, the Companies Act 2016, and the various statutes and regulations that bear on the conduct of business in Malaysia. Opinions are prepared with reference to current Malaysian case law and statutory interpretation, and are expressed in the client's language rather than the language of internal legal memoranda.

Clients who engage the firm for its Continuing Counsel Year arrangement find that having a point of reliable legal reference available throughout the year changes how they approach commercial decisions. Questions that would otherwise be set aside — because the cost of formal advice seemed disproportionate — can instead be put to the firm in writing and answered within the arrangement's agreed scope.
